Terms of Use and Cancellation Policy

Definitions

Contractor, the individual interested in and designated as financially responsible for the charter in the form field, and responsible for email communication, confirmation, organization of travelers, and payment for the Charter service.


Contracted Party, VLI Logística, the company responsible for the local infrastructure of the Maria Fumaça Train Tour, represented in communications and negotiations by a specific department of BUSON, a partner company specializing in road ticket sales and technology.

The CONTRACTOR declares that the train tour, in the character of a CHARTER, subject to these terms of use, will take place according to the form filled out at the time of the Quote and confirmed by email. With round-trip configuration, permitted passengers, pre-defined date and time, with the right to use ending at the conclusion of the tour on the specified day.

The minimum advance booking time for the Maria Fumaça Charter is 30 days.

OBLIGATIONS OF THE CONTRACTED PARTY

Guarantee safety, organization, and operation according to the date established in the Charter quote negotiations. This includes ensuring that the appropriate vehicles are inspected and that qualified personnel are trained and capable of conducting the Maria Fumaça Train Tour.


Validate boarding individually, verifying the name and document of each passenger against the passenger list provided by the Contractor.

OBLIGATIONS OF THE CONTRACTOR

Make the down payment, corresponding to 40% of the quoted amount, within 3 business days, under penalty of losing the reserved date. Payment of this invoice confirms the service reservation between the Contractor and the Contracted Party.

Passenger List: Provide a list of the names and identification documents of all passengers participating in the Charter at least 7 days prior to the intended Charter date. Passengers not previously identified on the passenger list will not be allowed to board.

Present themselves as the individual responsible for contracting the Charter to VLI staff at least 1 hour before the Charter time, and instruct passengers to have photo identification for boarding validation, which will be checked against the previously provided passenger list.

COMPENSATION

The CONTRACTOR and CONTRACTED PARTY declare that the total cost of the train tour will be handled individually and exclusively for each quote request, via email, represented by Buson Tecnologia. The terms of use and cancellation policies are agreed upon herein.

PAYMENT POLICY

The quoted amount must be paid as follows:
Down Payment. Representing 40% of the agreed-upon quoted value, an invoice generated upon validation serves as a down payment and commitment to confirm the future charter. The non-payment of the Down Payment invoice (initial 40%) within 3 business days will result in the cancellation of the reserved date, without penalty to the Contractor, and will release the intended date for the Contracted Party to conduct other negotiations with interested parties.


Full Payment. The remaining 60% of the agreed-upon quoted value is due up to 15 days before the charter event listed in the quote. The non-payment of the Full Payment invoice (remaining 60%) up to 14 days prior to the Charter will result in automatic cancellation of the charter, incurring a fine and charges to the Contractor as per the Cancellation rules outlined here, and releasing the intended date for the Contracted Party to conduct other negotiations with interested parties.

CANCELLATION POLICY

Consult the current policies at the time of booking.

To formally request a cancellation, the person responsible for the contract must send an email to: atendimentovli@buson.com.br, providing the contract details, date, personal information, and reason for cancellation for official processing.

IMPOSSIBILITY OF TRAVEL BY THE CONTRACTED PARTY

In cases of station or stop suppression or trip cancellation, the user is entitled to a full and immediate refund of the amount paid, without any sales commission or compensatory penalty. Alternatively, and at their discretion, if availability allows, they may reschedule the ticket at no cost, in the same service category, in accordance with article 39, paragraph 10 of resolution 5974 of March 21, 2022.

PRIVACY AND PERSONAL DATA PROTECTION

The execution of the Charter service involves the processing of personal data, and therefore, the PARTIES agree to act in accordance with Law No. 13.709/18 – General Personal Data Protection Law (LGPD).

The CONTRACTED PARTY undertakes to implement technical and administrative security measures compatible with the processing activities carried out, to protect personal data from security incidents.

The CONTRACTOR will be solely responsible for the technical and administrative security measures of their environment. Under no circumstances will the CONTRACTED PARTY be held liable for security incidents involving personal data, damages, or losses caused by actions and/or omissions of the CONTRACTOR.
